KVKK Information Purpose of the legal regulation: In the 1st article of Law No. 6698, "The purpose of this Law is to primarily ensure the privacy of private life in the processing of personal data." "To protect the fundamental rights and freedoms of individuals and to regulate the obligations of real and legal persons processing personal data and the procedures and principles to be followed by them." Legal basis of information: Article 10 of Law No. 6698: (1) During the acquisition of personal data, the data controller or the person authorized by him/her shall inform the relevant persons; legal reason, d) It is obliged to provide information about its other rights listed in Article 11. It can be processed for current, specific, clear and legitimate purposes, with the express consent of the relevant person, provided that it is kept for a period of time that is limited and proportionate, related to the purpose for which it is processed, stipulated in the relevant legislation or required for the purpose for which it is processed. Purpose of processing personal data: We process the identity data of our guests and all persons entering and exiting our establishment on a daily basis to fulfill our obligations in accordance with the legislation to which we are subject, the contractual relationship we have established with our guests, the purposes of ensuring the security of our guests and similar guest, public and institutional interests.  We record the identity data of our employees in accordance with labor and social security legislation. We process the identity data of our employee candidates in order to evaluate their job applications; the data of visitors, suppliers, contractors and similar people with whom we have business relations for the purpose of commercial necessity and to ensure the security of our guests and our establishment. Collection of personal data and legal reason: As a necessity within the scope of obligations arising from the legislation, to be decisive in legal disputes in accordance with the contract we have made with our guests, to ensure that our guests are informed about forgotten belongings and similar situations. We record identity, address, telephone number, payment information when necessary and other necessary information in order to provide all kinds of information about our establishment to our guests and to offer the requested products and services. Payment Information: Credit Card Information and Bank Account Information. To complete guest reservation transactions, collect the accommodation fee, and provide guests with ease of payment. Invoice Information: Issuance of e-invoices/e-archive invoices as required by tax laws, submission of legal declarations, and execution of accounting processes.
License Plate Information: Vehicle. Creation and tracking of guest records and control of hotel entry and exit.
SPA Information: Registration of guests wishing to use SPA services, determination of SPA occupancy rate, safeguarding of guests' valuables before SPA use, and protection of guest life and property.

4-) PARTIES TO WHOM PERSONAL DATA MAY BE TRANSFERRED:
The personal data subject to this disclosure text, which is transferred for the purpose of fulfilling legal obligations, performing the contract between the parties, and ensuring the legitimate interests of the employer, and the places to which it is transferred are listed below.

Access Logs: All accesses to databases and reservation systems are monitored by keeping log records to detect unauthorized transactions. 6-) METHODS OF COLLECTING PERSONAL DATA AND LEGAL GROUNDS:

(*According to the Identity Reporting Law No. 1174, it is mandatory to transmit guests' identity information to law enforcement agencies.)
Personal data regarding guests' contact information is processed through forms filled out on the website, reservation processes, or by submitting the contact form digitally, contacting by telephone, or via written e-mail. In accordance with Article 5/2 - (f) of the KVKK, "If the processing of data is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject."
Personal data regarding guests' payment information is processed digitally when bank details are entered during reservations. In accordance with Article 5/1 of the KVKK, the explicit consent of the data subject is required. Personal data regarding guests' billing information is processed physically through verbal statements made by the guest at the reception, and digitally for payments made via the website. According to Article 5/2 – (c) of the KVKK (Personal Data Protection Law), this is done "if it is necessary for the data controller to fulfill its legal obligations."
Personal data regarding guests' camera footage is processed through security cameras located in the common areas of the HOTEL from the moment the guest enters the HOTEL for accommodation until their departure. According to Article 5/2 – (f) of the KVKK, this is done "if it is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject."
Personal data regarding guests' health information is processed physically upon verbal or written communication of allergen or food intolerance sensitivities by the guest to HOTEL personnel. According to Article 6/3 – (a) of the KVKK, this is done "if the data subject has given explicit consent."
Personal data regarding guests' license plate information; Personal data regarding guests' SPA information is processed when the vehicle is left in front of the HOTEL during the guest's visit. According to Article 5/2 - (f) of the KVKK (Personal Data Protection Law), "Processing of data is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject." Personal data regarding guests' SPA information is processed when the guest's personal data is physically entered into the SPA entry-exit schedule while they are using the SPA service. 3) PURPOSES OF PROCESSING PERSONAL DATA:

Your personal data is processed for the purposes of ensuring physical security of the premises, protecting the life and property of guests, staff, or third parties, and obtaining evidence suitable for proof in possible disputes.

4) PARTIES TO WHOM PERSONAL DATA MAY BE TRANSFERRED:

Your personal data may be transferred to Judicial Authorities and Law Enforcement Authorities for the resolution of legal disputes or as required by relevant legislation.

5) METHOD OF COLLECTING PERSONAL DATA AND LEGAL GROUNDS:

Your personal data is automatically processed through a total of 80 closed-circuit security cameras (CCTV) located at the entrance and exit doors of the HOTEL, the building's exterior, the dining hall, the guest waiting area, and the floor corridors. Security cameras only record images; no audio recordings are made. Your personal data is processed based on the legal grounds stipulated in Article 5/2 – (f) of the KVKK (Personal Data Protection Law), namely, "the processing of data is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject."

6-) PERSONAL DATA RETENTION PERIOD:

In accordance with our hotel's personal data retention and destruction policy, security camera footage is stored for a period of 3 months. Following this period, the hotel will delete, destroy, or anonymize the personal data during the first periodic destruction process.

7) RIGHTS OF THE DATA SUBJECT:

The natural person whose personal data is processed is defined as the data subject and has the following rights by applying to the workplace: a) To learn whether personal data is being processed, b) To request information regarding the processing of personal data if it has been processed, c) To learn the purpose of the processing of personal data and whether it is being used in accordance with its purpose, d) To know the third parties to whom personal data has been transferred, domestically or abroad, e) To request the correction of personal data if it is incomplete or inaccurate, f) To request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7, g) To request that the actions taken pursuant to clauses (d) and (e) be notified to the third parties to whom the personal data has been transferred, h) To object to a result that is detrimental to the individual arising from the analysis of processed data exclusively through automated systems, i) To demand compensation for damages if the individual suffers damage due to the unlawful processing of personal data.

In accordance with Article 11 of the Law No. 6698 on the Protection of Personal Data, titled "Rights of the Data Subject," you can submit your requests regarding your personal data in writing to Yıldız Posta Cd. Depending on the nature of the request, a response will be provided free of charge in writing or electronically as soon as possible, and no later than thirty days. However, if the process requires additional costs, a fee may be charged according to the tariff determined by the Board.
